If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order and refund any amount paid.

Free shipping

We offer free standard shipping on all orders shipped to the United States and Australia, with no minimum order value required. Statutory rights

Nothing in these Terms of Service limits any statutory right you hold as a consumer under the law of your country, including the Australian Consumer Law for customers in Australia. Australian Consumer Law Guarantee

This section applies to customers who acquire goods from Micotix as consumers in Australia and sets out a mandatory notice required under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms of Service, and nothing elsewhere in this document, excludes, restricts, or modifies any consumer guarantee, right, or remedy that you hold under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) and that cannot lawfully be excluded, restricted, or modified. This notice applies in full regardless of the governing law clause set out in Section 12 of these terms, or any other clause in this document that might otherwise be read to limit our obligations or your rights. Where any provision of these terms is inconsistent with your Australian Consumer Law guarantees, the Australian Consumer Law prevails to the extent of that inconsistency.

Your rights under the Australian Consumer Law exist independently of, and in addition to, our 30-day return window described in Section 08. If a fault appears after 30 days, please still contact us at info@micotix.com, as your Australian Consumer Law guarantees may still apply.

Disclaimers & Limitation of Liability

Limitation of liability

Micotix’s liability is limited to the maximum extent permitted by applicable law.

Our website and products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Micotix, Ammar Commerce Limited, and their respective directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, our website, products, or services.

Indemnification & DMCA

This section covers your obligation to defend Micotix against certain claims, and how we handle notices of alleged copyright infringement.

Indemnification

You agree to indemnify, defend, and hold harmless Micotix, Ammar Commerce Limited, and their respective affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable legal fees, arising out of or in any way connected with: (a) your access to or use of our website; (b) your violation of these Terms of Service; (c) your violation of any applicable law or the rights of any third party; or (d) any content you submit to the website. This indemnity does not apply to the extent a loss arises from our own negligence or from any right that cannot be waived under applicable law.

If you believe that content on micotix.com infringes your copyright, please send a written notice to info@micotix.com identifying the copyrighted work, the material you believe infringes it, and your contact information, consistent with the notice-and-takedown approach of the US Digital Millennium Copyright Act. Governing Law & Disputes

These Terms of Service are governed by and construed in accordance with the laws of the United Arab Emirates, the jurisdiction where Ammar Commerce Limited is domiciled, without regard to conflict of laws principles.

Jurisdiction & governing law

UAE law governs these terms, without prejudice to your mandatory consumer rights at home.

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the website, or any order shall be subject to the courts of the United Arab Emirates, except where mandatory consumer protection law in your own country requires otherwise, or gives you the right to bring proceedings in your local courts.

Australia, ACL precedence

For customers in Australia, the Australian Consumer Law guarantees described in Section 09 apply and take precedence over this UAE governing law clause to the extent of any conflict, even though the entity behind Micotix is domiciled in the UAE. This choice of law does not remove any right you have to bring a claim before an Australian court or tribunal where the law requires it.

United States

This UAE governing law clause does not remove any mandatory consumer protection right available to you under applicable US federal or state law.

Mandatory rights always prevail

Regardless of the governing law and jurisdiction set out above, nothing in these Terms of Service excludes, restricts, or limits any right or remedy you hold under mandatory consumer protection law in your own country, including, without limitation, the Australian Consumer Law guarantees described in Section 09, which cannot be excluded.

We may update these Terms of Service from time to time to reflect changes in our practices, applicable law, or for other operational or regulatory reasons.
